These Website Terms of Use ("Terms of Use") govern your use of the Southern Garage Doors website, online booking system, and AI-assisted phone system. By accessing our website, submitting a booking request, or interacting with our phone system, you agree to these Terms of Use.

These Terms of Use are in addition to — and do not replace — our Terms of Service and Privacy Policy, which govern the in-person service relationship. In the event of a conflict between these Terms of Use and the Terms of Service, the Terms of Service control for matters related to in-person service.

1. Website Content — Informational Only

All content on this website — including service descriptions, pricing information, scheduling availability, warranty terms, and promotional materials — is provided for general informational purposes only and does not constitute a binding offer, contract, or guarantee. Pricing displayed on the website is subject to change without notice and may vary based on the specific conditions of your property and garage door system.

No information on our website or provided by our phone system creates a binding agreement until a formal estimate is reviewed and approved by the Customer in accordance with our Terms of Service.

2. Online Booking

Online bookings submitted through our website or scheduling system are requests for service, not confirmed appointments. All booking requests are subject to availability confirmation by our office, verification that the service address is within our service area (Sarasota and Manatee Counties, Florida), and confirmation that the requested service is within our scope of work. A booking is confirmed only when you receive an explicit confirmation from Southern Garage Doors by phone, text, or email.

3. AI-Assisted Phone System

Southern Garage Doors uses an AI-assisted phone system ("AI System") to handle inbound calls, described in detail on our AI Disclosure page.

AI-provided pricing is an estimate, not a binding quote. All pricing communicated by the AI System is based on standard rates and the information provided by the caller. The technician's on-site assessment and the approved estimate are the binding price. The AI System may misinterpret or incorrectly transcribe information provided verbally; it cannot provide legal, safety, or engineering advice; and complex situations, complaints, or disputes are escalated to a human.

Southern Garage Doors is not liable for errors, omissions, or inaccuracies in information provided by the AI System where the technician provides the final assessment, estimate, and approval process on-site. If you believe the AI System has provided incorrect information, please contact our office directly at (941) 356-4334.

All calls are recorded in accordance with Florida Statute § 934.03. A recording and AI disclosure is provided at the beginning of every call; by continuing the call, you consent to the recording and to interaction with the AI System. Call recordings, transcripts, and data collected during calls are handled in accordance with our Privacy Policy.

4. Intellectual Property

All content on this website — including text, graphics, logos, images, and design elements — is the property of Southern Garage Doors, Inc. and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our website content without our prior written consent, except for personal, non-commercial use such as printing a page for your own reference. 8. Limitation of Liability for Digital Services

To the maximum extent permitted by Florida law, Southern Garage Doors, Inc. shall not be liable for errors, inaccuracies, or omissions in website content or AI-provided information (where the on-site estimate and approval process provides the final verification); losses arising from reliance on website content without on-site verification; interruptions or failures in website, booking, or phone system availability; unauthorized access to or alteration of your data transmissions; actions of third-party service providers linked from our website; or technical malfunctions, including AI system errors and transcription inaccuracies.

Our total liability for any claim arising from the use of our website, online booking system, or AI phone system shall not exceed one hundred dollars ($100). This limitation does not apply to claims arising from our Terms of Service related to in-person service, which are governed by the limitation of liability in those Terms, and does not apply to claims that cannot be limited under applicable law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Southern Garage Doors, Inc. from any claims, damages, or expenses arising from your violation of these Terms of Use, your misuse of our website or phone system, or your provision of false or misleading information through our digital services.

10. Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of the State of Florida. Any disputes arising from the use of our website, online booking system, or AI phone system are resolved in accordance with the dispute resolution provisions in our Terms of Service: good-faith direct resolution, then non-binding mediation in Sarasota County, Florida, then the courts of Sarasota County, Florida, with small claims court always available.

11. Changes, Severability, and Contact

We may update these Terms of Use from time to time to reflect changes in our digital services, technology, or legal requirements. Updated terms will be posted on this page with a revised effective date. If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
